An agreement between the client and ClaimsXpert reached after the acceptance of the mentioned and required terms by the client. Once the client has acknowledged the mentioned terms, ClaimsXpert agrees to provide its services.
After accepting the mentioned Terms and signed the Assignment Form, Client will be agreed to obtain Justice as a Service and ClaimsXpert will also be agreed to deliver Justice as a Service. When a client will enter into the agreement with ClaimsXpert, then it will be his/her sole responsibility that he/she has entered into the agreement through their own behalf and ClaimsXpert never forced them to sign this agreement without reading the terms.
The Client accepts that that ClaimsXpert only seeks Flight Compensation. The Client also concurs that ClaimsXpert will not agree to any kind of travel vouchers or benefits as Flight Compensation. If any offer got from airlines, then it will be considered as the refusal of payment.
Once the client has signed the assignment form, the client may not assign the claim to any other party or website. If there is any existing assignment had made with another party, then it must be cancelled before signing the Assignment Form.
In case the client get any kind of direct payment or compensation from the concerned airlines after signing the Agreement, then it is very important that the client inform or advise to ClaimsXpert without wasting their time. Any kind of payment received from airlines will be considered as flight compensation and entitle as Service Fee and Legal Action Fee to ClaimsXpert if any kind of Legal Action was taken by ClaimsXpert.
After signing the Assignment Form, the Client shall be appreciative to stop negotiations with the concerned airlines and straightforwardly any contact made by the airline to ClaimsXpert in order to make sure that ClaimsXpert attain a reliable and best result.
Justice as a ServiceClaimsXpert always asserts the Client's Claim for Flight Compensation from the concerned airlines on the basis of Regulation 261/2004. There could be any other Air Passenger Rights Regulation in force applicable to the Client's particular air travel.
Any kind of information and flight data can be submitted to ClaimsXpert via emails, website or other electronic source supported by ClaimsXpert.
To ensure the Claim successfully, the client would need to provide the signed Assignment Form to the ClaimsXpert that he/she can send to ClaimsXpert through any source of their choices such as email, website, mobile apps or any other. After receiving the Client's signed Assignment Form ,ClaimsXpert begins to work on the query and arranges a request for payment and consign it to the operating airline without any delay. If the airlines pay any kind of Flight Compensation, then ClaimsXpert charges its Service Fee.
In case the operating airline fails to pay Flight Compensation to the client within a proper time period after being notified by ClaimsXpert and provided the case may be asserted with sufficient certainty, ClaimsXpert may initiate Legal Action to chase the Claim. ClaimsXpert will charge the Legal Action Fee in addition to the Service Fee, to cover up the supplementary costs of Legal Action.
Data and information from the ClientIf needed, the client will have to provide all the information or data to ClaimsXpert which is needed for the implementation of the Agreement. The Client makes sure that the entire data and information provided by his/her is correct and complete.
The Client agrees to fully indemnify ClaimsXpert in all respects for all third-party claims including, but not limited to, incorrect Client communications, provision of incorrect data/information and fraudulent conduct.
In case of incorrect information/date and fraudulent conduct, ClaimsXpert reserves the right to terminate the Agreement with an immediate effect. In case the Agreement is terminated, the Client will not have any right to compensation.
Right of withdrawalYou can simply withdraw your acceptance of our Agreement within 14 days from the conclusion of the Agreement. To work out your right to withdrawal, the withdrawal must be communicated within the 14-day period mentioned above and it must clearly state that you wish to withdraw from the Agreement.
Final ProvisionsClaimsXpert have rights to change these Terms and the Price List and can be changed anytime without any notification. The client may check the Terms section on our website regualarly. ClaimsXpert also apply the laws of Germany to these Terms, the Assignment Form and the Agreement between ClaimsXpert and the Client. The Client always entitled to claim due to protection under mandatory provisions provided by laws of the country where the Client resides.
